Abstract

This chapter considers the manner in which the UK’s highest courts have met the challenge of maintaining fair trial rights in an era of unprecedented change in criminal justice. Emphasis is placed on the framework of the Human Rights Act 1998 and the need for courts to take account of the judgments of the European Court of Human Rights. Particular attention is given to how the senior judiciary has responded to restrictions on fundamental principles of fairness and fair criminal trial standards and to evolving standards of fairness in pre-trial and post-trial procedures.
