Abstract

Considers whether exceptions to provisions of the Criminal Justice Act 2003 s.100 limiting the admissibility of bad character evidence in relation to non-defendants may be used by the defence to make misconduct allegations against a prosecution witness, which are denied and may generate satellite litigation. Reviews the background to the s.100 shield, its practical operation, and how the risk of such satellite proceedings might be reduced.
