Abstract

This chapter explores the role played by the public interest in non-publicity in Bloomberg LP v ZXC, in which the UK Supreme Court held that a reasonable expectation of privacy was a  ‘legitimate starting point’ for individuals under investigation pre-charge in the UK. The chapter argues that this marks an important shift in emphasis in an area commonly seen through the lens of individual rights and private interests in non-publicity.
