Abstract
Inclusivity or inclusiveness is a concept that lies at the heart of intellectual property. IP is all about sharing innovation, brands and providing society with literary and artistic works. But what does that tell us about the legal treatment of nationality in the international intellectual property system? Nationality as a criterion does not seem to fit in easily with the idea of inclusiveness. At first glance it seems to be a tool to exclude those with the wrong nationality. This chapter therefore looks at the combination of nationality in the international intellectual property conventions on the one hand and inclusiveness on the other hand under the motto ‘appearances are not what they seem’.
